Fallow Group LLC (a Wyoming limited liability company)

1) Quick Disclosures

Liability is limited as set out in Section 11.

Items marked “Final sale” or “Non-Returnable” aren’t refundable unless defective (see Section 9).
2) Introduction
This website and associated pages (the Site) are operated by Fallow Group LLC (“Fallow”, “we”, “us”, “our”). These Terms & Conditions (the Terms) are a contract between you and Fallow when you place an order, subscribe, or otherwise use the Site.
By using the Site or placing an order, you accept these Terms. You must be 18+ to purchase.
3) Use of the Site
You agree not to engage in prohibited conduct, including:

Infringing privacy or intellectual property rights;

Defaming, harassing, threatening, or offending others;

Unlawful or fraudulent activity;

Interfering with or disrupting the Site;

Uploading or transmitting viruses, malware, or harmful code;

Sending unsolicited messages;

Mining or scraping the Site (bots/robots) without permission; or
-
Aiding or permitting a third party to do any of the above.
4) Accounts
You may checkout as a guest or create an account. You must keep your account details accurate and secure. You’re responsible for all activity that occurs under your credentials. Personal data is handled under our Privacy Policy.
5) Orders
Placing orders. When you order products, you’re offering to buy them at the listed price(s), plus any shipping, taxes, and applicable fees shown at checkout.
Acceptance. We may accept or reject any order at our discretion. A binding agreement forms once we accept.
Cancellations (customer-initiated). You may request to cancel within 90 minutes of placing your order by emailing hello@fallow.co with your order number. If the order has already entered fulfillment, we may be unable to cancel.
Accuracy. Please review your cart, shipping information, and pricing before submitting.
Availability & pre-orders. All purchases are subject to availability. For items shown as pre-order, any ship dates are estimates only. We’re not liable for delays or changes to estimated dates.
Our right to cancel. We may cancel after acceptance if, for example, there’s a material stock issue, extended dispatch delay, suspected fraud, or error in description/price/image. We’ll notify you using the contact details provided.
6) Price & Payments

Currency. Unless otherwise stated, prices are in US Dollars (USD) and exclude applicable taxes, duties, and fees until shown at checkout.

Taxes & duties. We collect sales/use tax where required. For international orders, you’re responsible for customs duties, import VAT, and clearance fees.

Payment methods. Pay using the options presented at checkout (which may be provided by third-party processors). You confirm you’re authorized to use the selected method and won’t pay by fraudulent or unlawful means.

Promotions. Discount codes must be entered at checkout and can’t be applied to past orders, combined unless stated, or redeemed for cash. Each promotion may carry additional terms shown on the Site.
7) Subscriptions (if you opt in)
If you purchase a subscription (e.g., auto-deliveries):

You authorize us (and our payment processor) to charge the recurring amount at the interval shown until you cancel.

You can cancel or modify future renewals any time before the next charge/fulfillment window (via the customer portal or by emailing hello@fallow.co).

We may update subscription prices or terms with advance notice; continuing the subscription after notice constitutes acceptance of the update.

Keep your billing, shipping, and payment details current to avoid disruption.
8) Delivery, Title & Risk

Where we ship. We ship to the locations listed at checkout. Contact us if your location isn’t shown.

Timing. Any delivery windows shown are estimates.

Methods. We use common carriers and may require a signature or offer leave-safe options (where permitted).

Title. Title to products passes upon full payment.

Risk. Risk of loss passes upon delivery to your specified address (including where a leave-safe option is used).
9) Returns & Refunds
We want you to love your purchase. Subject to the below, you may request a return for change of mind within the period shown in our Returns Policy on the Site (if offered in your region). Conditions include:

Items must be unused, in original condition and packaging (including any seals, tamper-evidence, accessories, and promotional inserts).

Hygiene-sensitive items (e.g., skincare/haircare, cosmetics) cannot be returned if opened or used, unless defective.

Items marked “Final sale” or “Non-Returnable” at purchase are not returnable unless defective/damaged on arrival.

Return shipping for change-of-mind is at your expense. Please email hello@fallow.co with your order number and photos (if applicable) to initiate.
Bundles. If you return part of a bundle, the kept item(s) revert to the then-current single-item price; we refund the remainder.
Defects & shipping damage. If an item arrives defective or damaged, contact hello@fallow.co within a reasonable time with photos. If verified, we’ll offer a replacement or refund consistent with applicable law.
10) Product Information & Health Disclaimer
Site content and any product information, guides, or educational materials (the Materials) are for general information only and are not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. Consider your personal circumstances and consult a qualified professional for advice. Use of our products or the Materials does not create a doctor-patient relationship.
11) Warranty & Liability
To the maximum extent permitted by law:

We disclaim all warranties (express or implied) not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don’t allow limits on implied warranties; if so, the foregoing may not apply to you.

No consequential damages. Neither party is liable for indirect, incidental, special, punitive, or consequential losses (including lost profits, revenue, data, or goodwill).

Cap. Our aggregate liability arising from or related to these Terms or the products is limited to the amount you paid for the product(s) giving rise to the claim.

Comparative fault. Each party’s liability is reduced to the extent of the other party’s acts/omissions or failure to mitigate.
Nothing here excludes liability that cannot be excluded under applicable law.
12) Intellectual Property
All content, trademarks, trade dress, photos, text, graphics, and other materials on the Site are our intellectual property or used with permission. We grant you a limited, revocable, non-exclusive license to access and use the Site for personal, non-commercial purposes as intended. You must not copy, modify, distribute, create derivative works from, or exploit the Site or our content without prior written consent.
13) User Content & UGC
If you post, upload, tag, email, or otherwise submit content to us or the Site or our social media (User Content), you grant Fallow a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and otherwise exploit that User Content in any media for marketing and operational purposes. You represent and warrant that you own or control the necessary rights in the User Content and that its use won’t infringe others’ rights or violate law.
14) Promotions & Multi-Buy Offers
From time to time, we may run sales, discount codes, or multi-buy offers. Unless expressly stated otherwise:

Offers are while supplies last;

They cannot be combined or applied to prior purchases or gift cards;

Per-offer terms shown on the Site apply and may be changed or withdrawn at any time.
15) Mobile Messages (Email & SMS)
By opting in (e.g., checking a box or submitting your number/email), you agree to receive recurring marketing messages (and service messages like order updates). Message/data rates may apply.

Opt-out: Email—use the unsubscribe link. SMS—reply STOP (HELP for help).

Consent is not a condition of purchase. Carrier is not liable for delayed/undelivered messages. We only use your data per our Privacy Policy.
16) Third-Party Services & Links
We use third-party providers (e.g., payment processors, fulfillment partners, analytics/ads). Your use of those services may be subject to their terms. Links to other websites don’t imply endorsement; review their policies before using.
17) Force Majeure
We aren’t liable for delays or failures caused by events beyond our reasonable control (e.g., carrier delays, shortages, strikes, acts of God, internet or utility failures).
18) Disputes, Governing Law & Venue
First, let’s try to work it out—contact hello@fallow.co and we’ll seek a good-faith resolution. These Terms and any dispute are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. You and Fallow submit to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming for disputes not otherwise resolved.
(If you prefer an arbitration + class-action waiver clause, tell me and I’ll swap this section for a standard US e-commerce arbitration provision.)
19) Notices, Assignment & Changes

Notices. Email us at hello@fallow.co. We’ll contact you at the email/address you provided.

Assignment. You may not assign these Terms without our written consent. We may assign to an affiliate or in connection with a merger, sale, or restructuring.

Changes to Terms. We may update these Terms by posting on the Site. The Terms in effect when you place an order apply to that order.

Severability & Waiver. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision isn’t a waiver.
